Content of notice

General
Notices must be in PDF format, including images and maps. The maximum file size allowed for upload is 10MB. Bookmarks in PDFs are not maintained.
Legislative requirement
Your instrument needs to be gazetted as a notice if there is a legislative requirement that it must be published in the NSW Government Gazette. If the legislative requirement is that the notice may be published in the Gazette, you can choose to arrange for gazettal.
Reference to parent instrument
Your instrument should contain reference to the instrument(s) and provision(s) that empowers it to be made. The lodgement form also requires this information to confirm submission.
Please check carefully to confirm there is a current legislative requirement that has not changed since you last lodged a similar notice. For example—
- Many notices under the Commonwealth Corporations Act 2001 are now required to be published on the Australian Securities and Investments Commission (ASIC) website rather than in the Gazette.
- Many appointments and delegations do not have a legislative requirement to be published in the gazette.
- Estate, probate and related notices can be lodged in the NSW Online Registry.
- State funeral notices are now published in News and Events on the NSW government website.
- Some notices require publication in an appropriate newspaper rather than in the Gazette.
Exceptions are made for notices from Parliament and the courts and may be made in other circumstances. If you would like to discuss waiving the legislative requirement for your notice, please email us at nswgazette.help@pco.nsw.gov.au.
Notice content and quality
The Parliamentary Counsel’s Office operates as the publisher of the NSW Government Gazette but cannot offer any legal advice about the content of your notice. You may need to seek legal advice from other sources to confirm your notice complies with any legislative requirements.
Gazette notices are important legal documents that become permanent records. All care should be taken by you to ensure they are correct in all respects.

Please note that PCO will NOT check your notice for editorial errors, but may contact you if your submission does not meet our other requirements (see below).
Notices cannot be withdrawn or corrected once published. A notice will need an erratum or may need to be wholly remade if published with errors. Errors may also create search problems for users. For more information about correcting an error, please email us at nswgazette.help@pco.nsw.gov.au.
Option of commencement clause
Instruments published in the Gazette are usually taken to commence upon publication of the gazette, unless the notice provides for the commencement on another (future) date. Thus, a commencement clause is not required but can be included if appropriate.
Approvals
In the Gazette lodgement portal you are required to declare that all necessary approvals have been obtained. It is your responsibility to know who the authorised decision-maker for your notice or instrument is under the relevant legislation. Notices should not be lodged without all appropriate approvals.
If the notice to be gazetted requires approval from the Governor, you will be required to confirm that the Governor has approved the notice at a meeting of the Executive Council.
